FAIRGROUND CONCESSION CONTRACT

 This agreement by and between the TRI COUNTY FAIR ASSOCIATION, INC. and the CONCESSIONAIRE witnessed:

    This permit is granted to Concessionaire for the sole purpose of operating (or selling) those items approved on the face of this contract for which Concessionaire agrees to pay the total contract amount as itemized. One-half of the space rental shall be paid at the time of execution of this agreement while the remaining balance of the total sum of all items agreed to be paid by Concessionaire shall be paid no later than the first day of the fair.

    Only one stand will be permitted to operate under the terms of this agreement. Each stand is required to have a separate contract. If Concessionaire does not claim his space by 10:00 am of the first day of the fair, his contract shall thereby be deemed forfeited and the space may be resold. In the event the concession is deemed objectionable by the Association it may, in its sole discretion, close the concession and in such event no refunds or other recourse shall be permitted to Concessionaire.

    The business conducted under this permit shall at all times be subject to the approval of the Association and within the provisions of the statutes of the state of Illinois. No merchandise is to be sold on the location prior to the first day of the fair. Operating hours for concessions are from 10:00 am to 10:00 pm.

    The privilege hereby granted shall be conducted according to the laws of the state of Illinois and without infringement upon the rights or privileges of others. Concessionaire agrees not to handle or sell any commodity or transact any business upon and within the premises assigned to it except that which is herein expressly stipulated and contracted for.

    After a site has been contracted for, no change in location will be permitted. In the event the same space is sold to two or more Concessionaires, the Association reserves the right to reassign the space in whatever manner it deems practical.

    No roving concessions, gambling, games of chance or skill, and no shows or exhibitions having lewd, immoral, or questionable features will be permitted.

    Space used for seats, benches, awnings, overhanging parts of a stand, including stake room for tents, must be kept within the space contracted for.

    Concessionaire will be required to keep all supplies and stock off the sidewalks and roadways.

    The premises described herein shall at all times be open to inspection by the Association or its authorized representatives.

    All electrical consumption, wiring, and installation of electrical apparatus shall be at the expense of the Concessionaire and under the supervision of the Association's representatives. Concessionaire must furnish a suitable fuse box and all wiring within his concession.

    No loudspeakers, amplifiers, radio, or other broadcasting device may be used on the location described in this contract in the absence of the written consent of the Association.

    No part of the space described in this agreement may be sublet or transferred without the written consent of the Association.

    The Association reserves the right to regulate the parking of all motor vehicles within the fairgrounds. No automobiles, trucks, or trailers will be permitted to park on contracted concession space without a special vehicle permit.

    All food and/or drink stands and dining halls must comply with applicable state food laws and sanitation regulations pertaining to temporary food service operations. The agency will close immediately any food stand or dining hall which fails to comply with sanitation requirements and/or state laws pertaining to food.

    Garbage cans must be furnished by Concessionaire and they shall be covered at all times. Garbage will be removed daily at the instance of the Association which shall bear the cost thereof. Premises within ten feet of Concessionaire's concession must be kept free of refuse and waste matter. Furthermore, refuse and waste paper must not be placed outside of said ten foot area after night crew has cleaned the area in which the concession is located.

    Concessionaire must post in a conspicuous manner inside the stand and at the outside entrance to its place of business, a sign showing the price to be charged for meals, lunches, drinks, or other food or articles to be sold under this agreement. This size of said sign, manner and place of posting shall be subject to approval of the Association.

    No person who has or is suspected of having a communicable disease or who has any sores or skin eruptions will be permitted to work in or be employed in any food or drink stand or dining hall on the fairground premises.

    All of Concessionaire's materials and equipment must be removed from the fairgrounds within three (3) days after the closing day of the fair.

    In the event Concessionaire, its agents, or employees, shall violate any of the conditions of this agreement, all further right to transact business under this contract shall, at the option of the Association, at once become forfeited without any right on the part of the Concessionaire to recover any part of the purchase money already paid on contract, and Concessionaire and its equipment shall be removed from the fairgrounds without delay.

    It is mutually agreed that the Association will not be held liable for any loss sustained by Concessionaire in any manner whatsoever. Concessionaire further agrees to carry workman's compensation insurance for all Concessionaire employees to the extent required by statute. Concessionaire further agrees to accept liability for any injuries and further agrees to indemnify the Association for any claims or actions by third parties resulting from personal injury or property damage at or near the premises described herein. Concessionaire further agrees to carry general and product liability insurance in the amount of one million dollars and holds harmless the Association, and agrees to name the Association as an additional insured and to submit to the Association a certificate of insurance with limits of one million dollars.

    Concessionaire's concession must be in place and ready to open by 12:00 pm on the first day of the fair, and shall not depart until the last day of the fair at 7:00 pm.
